Q. For Voluntary Amendment, could you please provide us with the detailed information of the opportunity for submitting the Voluntary Amendment?

A. The allowed time period for filing amendments under the Korean Patent Act:

1. You can file voluntary amendments before a preliminary rejection is issued;

2. You can file amendments within the time period of responding to a preliminary rejection, a final preliminary rejection or a final rejection;

3. If there is no preliminary rejection, you can file voluntary amendments only before a Notice of Allowance (hereinafter, “NoA”) is issued. That is, if a NoA is issued without any preliminary rejection, there is a risk to lose a chance to file amendments.
